1. About these terms
These terms are an agreement between you and Sprout ("Sprout", "we", "us"). They cover your use of the Sprout iOS and Android apps and the services behind them (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Sprout.
Sprout can be used only through our official mobile apps. This website is for information only.
2. Sprout is not medical advice
Sprout is a record-keeping tool, not a medical device. Feed reminders, "next feed" estimates, side suggestions, alerts and insights are general conveniences based on what you log. They are not medical, clinical or feeding advice and are not a substitute for a midwife, health visitor, doctor or other qualified professional.
Always follow professional guidance on your baby's feeding, sleep and health. Don't rely on Sprout's reminders as your only prompt for care. If you're worried about your baby, contact a healthcare professional. In an emergency, call your local emergency number.
3. Who can use Sprout
You must be at least 18 years old and able to enter into a binding contract. By adding a baby to Sprout, you confirm that you are that baby's parent, legal guardian or an authorised carer, and that you have the right to record and share information about them.
4. Your account
- Give accurate information when you sign up, and keep your email address up to date so you can reset your password.
- Keep your password confidential and your devices secure. You are responsible for activity on your account.
- Tell us straight away at privacy@example.com if you think someone else has accessed your account.
5. Households and sharing
A household is a shared space for the people caring for the same baby or babies. When you invite someone using a pairing code and they join:
- every member can view, add, edit and delete the household's babies, activity logs and photos;
- every member can view each other's parent-sleep entries, but only you can change your own;
- a baby stays with the household it was created in. If you leave, you lose access to that household's babies, logs and photos.
Share pairing codes only with people you trust. Disagreements between household members, such as who should have access, are for you to resolve. We can't decide between members, but we will help where we reasonably can.
6. Your content
Everything you add to Sprout, including logs, notes and photos ("your content"), stays yours. You give us a limited licence to store, copy, process and display your content only as needed to run the Service for you and your household, such as syncing it, generating thumbnails and calculating insights. This licence ends when your content is deleted, apart from the short backup periods described in our Privacy Policy.
You confirm that you have the right to upload your content. In particular, photos must not include other people without the right permissions.
We recommend keeping your own copies of photos that matter to you. Sprout is not a backup service.
7. Acceptable use
You agree not to:
- use Sprout for anything unlawful, or to upload content that is unlawful, harmful or infringes anyone's rights;
- upload content that sexualises or exploits children in any way. We will report such content to the authorities;
- try to access another household's data, or anyone's account without permission;
- probe, scan or test the Service's security, or interfere with its operation, except through a responsible disclosure to us;
- reverse engineer the apps or API, or access the Service with bots, scrapers or unofficial clients, except as the law allows;
- resell, sublicense or commercially exploit the Service.
8. The service
- We're always improving Sprout, so features may change, be added or be removed. If we remove something important to you, we'll try to give you notice.
- We work hard to keep Sprout available, but we can't promise it will always be uninterrupted or error-free. The Service runs on third-party infrastructure (including Laravel Cloud), and maintenance or outages may happen.
- Reminders and notifications depend on your device, its settings and the operating system's push services. They may be delayed or not delivered.
- Optional integrations such as Apple Health are provided by third parties and are subject to their own terms.
9. Fees
Sprout is currently free. If we introduce paid features, we will tell you the price clearly before you are charged. Purchases will be handled through the Apple App Store or Google Play and will be subject to their payment and refund terms. We won't move an existing free feature behind a paywall without reasonable notice.
10. Ending your use
You can stop using Sprout and delete your account at any time from the app's settings. What happens to your data is explained in our Privacy Policy.
We may suspend or close your account if you seriously or repeatedly break these terms, if we must for legal reasons, or to protect other users or the Service. Where reasonable, we will give you notice and a chance to export your content first. If we ever shut Sprout down entirely, we will give you at least 30 days' notice.
11. Our liability to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited by law. Your statutory rights as a consumer are not affected.
Subject to that:
- Sprout is for personal, non-commercial use. We are not liable for any loss of profit, business or business opportunity.
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
- We are not responsible for decisions made based on Sprout's reminders, estimates or insights in place of professional advice (see section 2), or for missed or delayed notifications.
- We are not responsible for content that household members add, change or delete.
- While the Service is free, our total liability to you for any claim is limited to £100, to the extent the law allows.
12. Apple App Store and Google Play
If you downloaded Sprout from the Apple App Store:
- these terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to meet an applicable warranty, you may notify Apple and Apple will refund any purchase price paid. To the maximum extent the law allows, Apple has no other warranty obligation for the app;
- we, not Apple, are responsible for handling any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims;
- you confirm that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Your use of the app must also comply with the App Store's or Google Play's own terms of service. If those terms conflict with these, theirs apply to the extent of the conflict.
13. Changes to these terms
We may update these terms, for example to reflect new features or changes in the law. If the changes are significant, we will notify you in the app or by email at least 14 days before they take effect. If you keep using Sprout after that, you accept the new terms. If you don't agree, you can delete your account before they apply.
14. Governing law
These terms are governed by the laws of England and Wales, and disputes may be brought in its courts. If you live elsewhere in the UK or in the EU, you keep the protection of the mandatory laws of your home country and can bring proceedings in your local courts.
If any part of these terms is found to be unenforceable, the rest stays in effect. If we don't enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms. We may transfer ours to another organisation, and if we do, your rights will not be reduced.
